Official Rules & Regulations

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR TO WIN.  A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.  NO SUBMISSION TO A SALES PRESENTATION REQUIRED.  ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY.  VOID WHERE PROHIBITED.

ELIGIBILITY:  Bath Fitter & Riverset Credit Union, “Pittsburgh’s Ugliest Bathroom Contest” (“Sweepstakes”) is sponsored by Bath Fitter & Riverset Credit Union (“Sponsors”) and administered by WPXI, Inc. (“Administrator”).  To enter, you must be at least eighteen (18) years of age at the time of entry and you must legally reside in the State of Pennsylvania.

Employees of Bath Fitter, Riverset Credit Union, WPXI, Inc., Cox Broadcasting, Inc., the National Broadcasting Company, and each of their respective affiliated companies, subsidiaries, and advertising or promotional agencies, and the immediate family members of, and any persons domiciled with, such employees, are not eligible to participate or to win.

ENTRY AND WINNER SELECTION:  The Sweepstakes will begin at 9:00 a.m. (E.T.) on Monday, February 11, 2013 and end at 11:59 p.m. (E.T.) on Sunday, March 10, 2013.  To enter:

Visit www.WPXI.com or www.Pittsburgh.com and look for the Bath Fitter & Riverset Credit Union “Pittsburgh’s Ugliest Bathroom Contest” prompt or ad.  Click on the prompt or ad to reach the sweepstakes entry site.  Submit your bathroom photo, tell us why you think you should win, enter your name, address (including city, state and zip), email address, birth date and daytime telephone number (including area code) on the Sweepstakes online entry form.  Submit your entry by clicking on the “Click Here to Enter” button.  You may only submit one (1) photo and there will only one (1) prize per person.  Multiple entries by means of software generated or other automated processes will be disregarded.

At 9:00am on Monday, February 25, 2013 to 11:59pm on March 10, 2013, voting will be open to the public on the Bath Fitter & Riverset Credit Union “Pittsburgh’s Ugliest Bathroom Contest” page at www.wpxi.com. Users will be allowed to vote on their favorite photo five (5) times per hour. Voting will also be open to the public at the Bath Fitter booth or the Riverset Credit Union booth at the Pittsburgh Home and Garden Show at the convention center between Friday, March 1, 2013 and Sunday, March 10, 2013. The photo with the most votes will be announced on or about Monday, March 11, 2013, from among all eligible entries received during the Sweepstakes Period.  The entry pool for the Grand Prize drawing will consist only of eligible entries received during the Sweepstakes Period.  Entries received after 11:59 p.m. (E.T.) on March 10, 2013 will not be accepted.   

Administrator and/or Sponsors will not be responsible for incomplete, lost, late, or misdirected entries, or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Administrator.  Any questions regarding the number of entries submitted shall be determined by Administrator in its sole discretion, and Administrator reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Sweepstakes.  All entries become the property of Administrator and Sponsors and will not be returned.

PRIZE DESCRIPTIONS:  One Grand Prize winner will receive a new Bath Fitter bathroom remodeling (Approximately a $5,000 value) and a gift card from Riverset Credit Union (Approximately $250 value).

Odds of Winning:  The odds of winning depend on the total number of eligible entries received.

WINNER Notification and Acceptance:  Administrator will attempt to notify the winner by phone (correct daytime phone number, including area code, must be provided in all entry materials), during regular business hours, within five days following the Grand Prize drawing.  A confirmation email will follow phone notification.  Administrator’s inability to reach a winner and/or return of prize notification as undeliverable may, at the sole discretion of Administrator, result in that winner’s disqualification.  Winner may waive his or her right to receive a prize.  Prize and individual components of prize package are nonassignable and nontransferable.  An alternative or substitute winner will be selected.  No substitutions or transfers of prize by winner are allowed. Prize and individual components of prize package are subject to availability and Sponsors reserve the right to substitute prizes of equal or greater value.  Winner is solely responsible for payment of any taxes on prize.  Winner will be required to complete an affidavit of eligibility and a liability and publicity release (except where prohibited by law) which must be returned within ten (10) business days of date of sender’s postmark or hand-delivery.  Failure to timely sign and return the affidavit and release, or to comply with any term or condition of these Official Rules, may, at the sole discretion of Administrator, result in a winner’s disqualification and the forfeiture of his/her interest in the prize.  Except where prohibited, acceptance of a prize constitutes the winner’s consent to the publication of his/her name, voice, likeness, image, biographical information, and hometown in any media (including broadcast, print, and other media) for any commercial or promotional purpose without limitation or further compensation.  To receive a copy of these Official Rules or the winner’s names (available after March 31, 2013), please send a self-addressed stamped envelope to: Bath Fitter & Riverset Credit Union “Pittsburgh’s Ugliest Bathroom Contest”, “Official Rules Request” or “Winners List Request” (as applicable), 4145 Evergreen Road, Pittsburgh, PA 15214.  Please allow three weeks for delivery.  Official Rules are also available on the Sweepstakes entry site which is accessible via the Administrators’ websites (www.WPXI.com and www.Pittsburgh.com). 

PARTICIPATION; ERROR/FRAUD/MALFUNCTION:  By participating, entrants agree to be bound by these Official Rules and the decisions of the Administrator and Sponsors.  No more than the advertised number of prizes will be awarded.  Administrator and Sponsors, in their sole discretion reserve the right to disqualify any person found tampering with the entry process or the operation of the web site or otherwise found in violation of these Official Rules.  In the event the Sweepstakes is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Administrator, which corrupts or impairs the administration, security, fairness or proper operation of the Sweepstakes, Administrator reserves the right in its sole discretion to suspend, modify or terminate the Sweepstakes.  Should the Sweepstakes be terminated prior to the stated expiration date, Administrator reserves the right to award the prize based on the entries received before the termination date.

All submission data will be shared with Bath Fitter and Riverset Credit Union unless the user unchecks the opt-in box on the submission page.

Construction:  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any entrant and Sponsors and/or Administrator, shall be governed by, and construed in accordance with the laws of the Commonwealth of Pennsylvania, without giving effect to any choice of law or conflict of law rules or provisions (whether of Pennsylvania, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Pennsylvania.  The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision.  In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
